By accessing or using Fluyd (the "Service"), you agree to these Terms of Service ("Terms").

If you do not agree to these Terms, you must not use the Service.

To use Fluyd, you must:

• Be at least 16 years old; and
• Be legally capable of entering into a binding agreement under applicable law.

You agree to:

• Provide accurate and up-to-date information;
• Keep your login credentials secure;
• Not share your account with others; and
• Notify us immediately of any unauthorized access.

You are responsible for all activities conducted through your account.

Fluyd allows you to:

• Post training logs;
• Upload images;
• Comment on posts;
• Like content;
• Follow users.

You agree NOT to:

• Harass, abuse, or threaten others;
• Post harmful, hateful, or illegal content;
• Share private or confidential information of others;
• Upload copyrighted materials without appropriate rights;
• Use bots, scrapers, or other automated tools;
• Misuse WHOOP or health-related features;
• Use Fluyd for commercial purposes without prior permission.

We may remove content, restrict features, or terminate accounts that violate these guidelines.

You retain ownership of all content you upload to Fluyd.

By posting content, you grant Fluyd a non-exclusive, worldwide, royalty-free license to:

• Host;
• Store;
• Display;
• Modify (solely for formatting or technical purposes);
• Distribute according to your privacy and visibility settings.

We do not sell or commercially exploit your personal content.

This license ends when you delete your content, except where we are legally required to retain it or where it has been shared by other users.

If you choose to input or sync health data (e.g., height, weight, HR, HRV, calories burned, recovery scores), you acknowledge that:

• You voluntarily provide this information;
• It may constitute sensitive personal data under applicable law;
• You may delete this data at any time;
• WHOOP metrics are controlled by WHOOP, Inc., not Fluyd;
• Fluyd is not responsible for the accuracy of WHOOP data or any consequences arising from its interpretation.

You acknowledge that:

• Fluyd is not a medical device or a healthcare service;
• Insights, analytics, and WHOOP metrics are for informational purposes only;
• You must consult a qualified medical professional for any health-related decisions.

You agree not to:

• Engage in unlawful conduct;
• Copy, modify, or reverse-engineer any part of the Service;
• Access the accounts or data of others without authorization;
• Interfere with service functionality, infrastructure, or security;
• Use the Service in jurisdictions where its use is illegal.

We comply with the DMCA and equivalent global laws and may remove infringing content or terminate repeat violators.

If Fluyd offers paid subscriptions or features:

• Prices will be disclosed at the time of purchase;
• Refunds are provided only where legally required;
• Payments are processed by authorized third-party providers.

We may, at any time and without liability:

• Change or update features;
• Suspend or discontinue the Service;
• Restrict access;
• Remove or modify functionality.

We may suspend or terminate your account for:

• Violating these Terms;
• Posting harmful or illegal content;
• Abusing social features;
• Misusing WHOOP or health integrations;
• Engaging in harassment or harmful behavior.

You may delete your account at any time.

To the maximum extent permitted by law:

• Fluyd is not liable for indirect, incidental, consequential, or exemplary damages;
• We are not responsible for inaccurate WHOOP data or user-generated content;
• Our total liability for any claim is limited to the amount you paid (if any) in the 12 months preceding the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

You agree to indemnify and defend Fluyd against claims arising from:

• Your use of the Service;
• Content you post;
• Your violation of these Terms;
• Your interactions with other users;
• Your reliance on third-party or WHOOP data.

Unless prohibited by local law, these Terms are governed by the laws of the United Kingdom.

Any dispute arising out of or relating to these Terms may be resolved in the courts of the United Kingdom or through arbitration where applicable.

If any part of these Terms conflicts with mandatory local law (including GDPR or consumer protection rights), that local law will prevail to the extent of the conflict.

These Terms are provided in English.

Translations may be offered for convenience only.

In the event of inconsistency, the English version governs.
